I think you misundertood me. I agree with you that the Declaration is not law and is not ratified by the States. I am saying that it provides a context for interpreting the constitution when facing new situations that makes the constitution open to differing interpretation.

Secondly, the First Amendment was not interpreted in the light of the DoI. I simply described the reasoning for why freedom of speech means freedom of expression. Will you take the position that people born without the gift of speech have no first amendment protection? Or will you limit First Amendment protection of alternative forms of speech only to those who are born without the gift of speech?
