Didn't that happen regarding segregation? Was it constitutional then?

Some things are just right.

The only real argument against gay rights is a religious one, and that shouldn't stand up in court for bupkus.

Nope, the courts interpret the law and then make new law........the legislature is then supposed to implement the new law. Courts are made up of lawyers..........they are students of the law. That's why they have the responsibility to interpret and redefine the law. Even if the legislature does create a new law, if its deemed unconstitutional, its thrown out by the courts.
