1.Virginia's state Constitution would not allow them to declare a state religion and Thoams knew this....he is reading the Constitution very narrowly....I happen to agree with the approach....the legislature needs to do its job....

2. I happen to agree with Thomas...I don't beleive the Court's should second guess once the President determines an enemy combatant unless the determination is wholly unmerited.....

See WWII enemy combatant writings of the Supreme Court. Not all Constutional Rights have even been flowed down to the States via the 14th Amendment. I'm certain the first however has.
