When we went to bed on Nov. 2 the fate of Ohio was not known. BUsh did not put it away decisively even with the rigging. That is not what you call a mandate. They both went neck and neck and stopped shart of the needed majority. There was a reasonable doubt on the night of Nov. 2

And then those famous words of Kerry where he said that the fate of the elections needed to be decided by the voters directly and not by the lawyers and the Supreme court. On the night of Nov. 2, the situation was ripe for a legal challenge. I am not saying whether the challenge would go in one way or the other or not. But the legal challenge was possible. If Ohio was hanging in a balance after Bush got the 270 EVs then it would be worthless to challenge Ohio. But that was not the case.
