Thomas has been really good for the court. He knows the ubiquitous use of the Commerce Clause to regulate everything in everybody's lives, the way Stalin would have loved. He knows that 60% of the Federal Govt is flat out illegal because departments have no power under the commerce clause to regulate what they are regulating. There is an interesting Commerce Clause case that may be heard by the Supremes. Its the Stewart home-made machine gun case. The DOJ finally submitted their Writ of Certiorari on Friday. Its not about machine guns, its about abuse of the Commerce Clause and whether something that has never ever moved in interstate commerce can be regulated by the Feds.
