The view that the only rights Americans should have are those specifically guaranteed by the Constitution is, in my view, a huge mistake. The Constitution assures certain rights, but I don’t think there’s anything there to say that no other rights can or should be asserted. It is inevitable that we will deal with situations that those who framed the constitution could not possibly have forseen. When we do, we have a simple principle to guide us: that individuals should be granted the largest degree of individual liberty consistent with the protection of the rights of other individuals.
