Not only that, but when Republicans have had to face a Democratic President and had the power to block judicial appointments they disliked, they did so.

Both parties have a legal right to do this and will if they can. If it's judged unacceptable, it's time for a Constitutional amendment.

I wouldn't hold my breath. A federal ban on gay marriage is a shoe-in in comparison.
