I'm not so sure this case will be a liability slam dunk and that MRK will share all of the blame. Remember the FDA sat on the data too. They can also make a pretty reasonable case that they weren't negligent. I don't think this is like phen-fen.

As far as numbers go, in terms of liability 10B is a number that I've heard mentioned quite a bit. Since a jury will probably get to decide, I think I would wait till hearing all the evidence.

If they covered up anything(which I doubt they did), take whatever number you were thinking of and multiply by 10.

It will be an EXPENSIVE trial. I think if they can settle out of court for $1B they will take it.

I don't know. They have insurance to cover a small part of the liabilities but it is well below 1 billion. It's anyones guess until the dust settles.
