We quote work all the time. Let me give you an example of what the prime contractor looks at:

They base their bid on specs. That is what I was referring to...the prime reports to the authority and the authority is ultimately responsible and will be sued too. Everyone involved will be sued and then it will be argued that the plans were certified by_____________ and the prime was meeting the plan. Then the game plays a switch and says but did you not know that it would have problems and the slurry will come into play...and it will follow through that way forever. Been there before and fortunately have been relieved of responsibility. In our case they tried to sue us because we over designed the box because their design was bad and we would not build it to their spec. It was proven we were right and that the contractor and the original engineering firm were responsible.

Construction of Concrete Median Barrier, Resurfacing and Incidental Work

Sealed bids for Construction of Concrete Median Barrier, Resurfacing and Incidental Work, will be received at the Office of the Contract Administrator, Massachusetts Turnpike Authority, The John T. Driscoll Building, 668 South Avenue, Weston, Massachusetts 02493 until 10:30 a.m., Prevailing Time, Thursday, February 12, 2004, at which time they will be publicly opened and read.

Work under this contract consists of pavement repairs; milling existing bituminous concrete pavement; furnishing and placing bituminous concrete leveling course and overlay; constructing concrete median barrier; modifying bridge parapets; removing median highway guard; constructing bituminous concrete berm; repairing, replacing, and adjusting drainage structures; installing attenuator systems; placing pavement markings; providing traffic control facilities; and all other items of work necessary to complete the project.

The Work sites are located between Mile 98.6 and Mile 103.2 in the Towns of Grafton, Upton and Westborough and Interchange 9 Mile 78.3 in the Town of Sturbridge.

Project Value: $ 10,000,000.00

Charge for Plans and Specifications: $50.00 per contract (not refundable).

Bid Documents will be mailed by Parcel Post upon request and receipt of an additional fee of $1.50 per pound, with a minimum charge of Ten Dollars ($10.00) per set, payable by separate check. Plans and Specifications for both contracts will be available for pick-up after 12 noon on January 22, 2004.

Prospective Bidders may obtain the Bid Documents, Bid Convenience Package(s) and complete information from the Massachusetts Turnpike Authority, Office of the Contract Administrator, The John T. Driscoll Building, 668 South Avenue, Weston, Massachusetts 02493. If there are any questions on Bid preparation or any of the Bid Papers, please contact the Contract Administrator at the Office of the Chief Engineer at 781-431-5133. All bidding shall be in strict accordance with the requirements of M.G.L. Chapter 30, Sections 39F through 39M inclusive, and all other required provisions of the Massachusetts General Laws as amended to date. Minimum wage rates have been established in accordance with M.G.L. Chapter 149, Section 26 to 27D inclusive.

Bidders are hereby notified that this contract shall have civil rights provisions and requirements in the areas of employment and contracting, pursuant to Administrative Bulletin 75-14 and Executive Order 390 of the Commonwealth of Massachusetts. Failure to cooperate and/or to demonstrate good faith efforts to comply with these requirements may render submitted bids non-responsive.
