I'm aware that there is no need to bring it to the court. Also the only source that I've seen that says conservatives will try to bring it to the Court is Kinsley so I wouldn't be surprised if he was wrong, however IF they did bring it to the court and the court went along with it then you would have a strong case of judicial activism.

Yes, they could. And with the addition of four Senators, they can now get around the moderate three Republicans who would not vote to do away with cloture. But they will use the threat instead of implimenting it if they can. They know they will be on the short end some day.
