The Marines had treated the wounded, he reported, left them behind and continued on Friday with their drive to retake the city from insurgents

All this episode means is that Marines will be less likely to leave wounded and living combatants behind. I wouldn't.

The Third Geneva Convention, the section of the 1949 treaty that applies to prisoners of war, says "persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat (out of combat) by sickness, wounds, detention, or any other cause, shall in all circumstances be treated humanely."

Does the above apply here?
Hanoi John Fonda Kerry admitted, in fact gloated in his written after action report, he had killed a wounded Viet Cong soldier, for which Kerry was awarded the Silver Star. His gunner, who machine gunned the fleeing soldier stated, when interviewed by the Boston Globe(NY Times), he didn't see how the guy could run with his legs shredded like that. Kerry caught him and shot him in the back as he fled. This Marine deserves the same Silver Star for saving his buddies lives.
