So you think he shouldn't be tried for murder if it is known that he intentionally killed a non-threatening wounded prisoner? I have to disagree. Its not just a matter of the Geneva convention. He wasn't just slapped around or treated harshly he was killed. The marine may have had reason to think the killing was justified, but if he didn't than it was simply murder.
