If this was a combatant, and did not put his hands up over his head and keep them there, he was still a combatant.

In guerrilla warfare/insurgencies, some combatants do not usually wear uniforms.
Determining a combatant during an assault can be impossible.

If they are wearing opposing uniforms they can be killed.
If they are armed and opposing us they can be killed.
If they are in civvies and not following surrender instructions on a hot battlefield they can be killed.
If you are certain they are civilians but are between you and opposing forces they can be killed.
If the good guys cannot figure out quickly that you are friendly, you are going to be killed.

I am being too kind. Change can be killed to must be killed.

Such is life and death in battle.
