Well, that's the crux of the debate, isn't it?

One way to analyze the match between intent and current regulations is to work it backwards. For example, does a public skating rink which bans Christmas music meet with the intent of anything Jefferson ever envisioned in his writings? Clearly, Jefferson never envisioned such a big government sprawl into so many areas of our culture. That is a relatively recent invention of government bureaucrats with wads of money collected from the people.

A more conventional way to look at it is to look at intent through consistency. e.g. Why is God OK on coins but not in police stations? OK in the Constitution (the year of "our lord") but not in schools?
