That's way too technical accountantese/pidgen-legalish for the common denominator whin... eh, "concerned participants", Dave. As a matter of simplification, addressing the most relevant points by redirection of said plaintiffs, via referral to Section G of the related post-contractual documentation contained within Subsection F, more specifically, Paragraph Y may prove most expedient.

"The APA is between Seller and Buyer, not users. The user relationship was and is governed by the TOU, as was the case with all previous owner entities. Section 6 of the TOU has the boilerplate "as is, as available, without warranty" language."
