If the new entrant claims not to be infringing any patents, it isn't easy for SNDK to do much until product is available to study. Then the investigation probably takes a while. Next there is presumably a "friendly" negotiation stage followed, if necessary, by litigation. The entire process could take a long time. And, as you point out, allowing the potential damages to accrue for a while isn't a bad idea if they could be tripled.
