if the destroyer had reason to know that the destruction was to hide illegal activity, then a case could be made for obstruction of justice

The catch is, you can't turn around and say that because destruction of evidence occurred, that that is in effect evidence of illegal activity.

Martha Stewart, recall, was convicted of obstruction, but not of the crime that was being investigated.
