You can convict them if they have committed a crime.

You are kidding yourself that a regular US court that let OJ Simpson walk would put people do death for being members of Al Qaeda, for which there are hardly any witnesses, whose crimes / plots to commit crimes have happened overseas.

If they haven't committed a crime, they aren't a terrorist.

Ok, are you now saying that Kerry who said he wants to kill Al Qaeda (and the jokesters who believed him) were for killing people who were not terrorists?

When someone signs up with Al Qaeda (and the like jihadist group), it may take a year or more before they get trained and in position to kill the infidel. So by your definition, they are not terrorists.
