But the Pentagon and the CIA argue that the post-September 11 era requires a new tougher approach and that many of the suspects are hardened terrorists who, if released, would plot fresh atrocities."

I am not sure if the issues have been properly defined or not. One complaint is that the USA doesn't have enough evidence to convict the detainees. Convict of what, being enemy combatants? They were apprehended in the act and no charges nor convictions are being engaged. Or, are we trying to charge them with being too hardened to be anything but a threat to our society upon their release? If so, it seems these too things are entwined. Have any of them made efforts to appeal this type of designation?
