If his point that "people who are simply living together can make whatever arrangements they want, whether they are heterosexual or homosexual" is valid, then why would anybody choose to get married? I still haven't heard a good explanation for that.

They want the 'rule set" of the state applied to their partnership. Then they don't have to draw up their own arrangements. But the key thing they want is the homosexual stigma removed. They want social acceptance.

Kholt, You can get married and have a prenuptial agreement to settle all the economic issues and property rights between you. So your agreement takes priority over marital law such as community property just like a will takes priority over intestacy statutes. By the same token, you can have a cohabitation agreement between opposite sex or same sex . And at least for opposite sexes living together, if their intent is marriage like, then the law of meretrious relationships applies absent a cohabitation agreement.

So right now, it makes there is little difference whether it is homosexual relationship or not except for all other laws of spousal entitlements created by the Federal government and the state governments.

Therefore to me the issue over gay marriage has to be trying to raise the status of a gay relationship to a marriage which is recognized legally and entitled to the different state and federal benefits . This is a decision for voters not judges IMO.
