The question was how do you know that each detainee wasn't already reviewed by the military and found not to be a POW and found to be an illegal combatant. What strikes me is that while POWs are not entitled to use the courts to challenge their detentions, why should a level of detainee even below the POW level obtain more rights than a POW by being able to challenge their detentions in courts AFTER the military has already examined the evidence and made their decision?
