Soldiers working under Saddam Hussain conduct a crime. (torture, arrest, and kill opponents or suspected opponents, and at times innocent people)

Soldiers working under George W. Bush conduct a crime (torture, arrest, and kill prisoners or suspected opponents, and at times innocent people)

Saddam is responsible for the actions of his soldiers. He is prosecuted.

George W. Bush is not held responsible for any actions. His soldiers are tried.

Still not clear about the logic...
