Many in detention are battlefield pickups from Afghanistan. At a minimum they are POWs. POWs are not allowed to challenge their detentions in the U.S. Courts, yet now the U.S. Courts are saying that they can. This of course means that if this was WWII and this ruling was issued, all 3 million German prisoners in U.S. Custody would have been able to flood the U.S. Court System to challenge their detentions. Now do you see the problem, especially for wars of the future?
