Unless there is some requirement for a courtroom with jurors and judges, seems to me any NCO or Officer in the field who picked up these individuals instantly adjudicated these individuals and determined that they are not POWs. I don't see any requirements for a formal process.

But lets say there was no adjudication for arguments sake. Then if the detainees are afforded the protections of the treaty prior to an adjudication, then NONE of the detainees is allowed to challenge their detentions in courts, because POWs are not allowed to challenge their detentions. That however is not whats happening.
