In my experience, and I've written a lot of these reports, you limit your assertions to what is clearly so. It's counter-productive to embellish with what can be contested, particularly if those embellishments don't add to the penalty.

I can certainly understand that, particularly in this litigious age. However, by taking this line, the penalty seems a bit harsher than it ought to be. On the other hand, the kind of breach we are discussing certainly is one for which discharge is appropriate.

It's not a big point to me, simply a bit of a puzzling anomaly. Thanks for throwing a bit of light on it.
