You have missed the point.

You aren't going to know for sure you have a terrorist until after the fact. You will inevitably torture some innocents on your quest to torture the guilty. You may want to live that way- but our founding fathers were reacting against the star chamber. I realize you may not consider our protections that important anymore, because your safety is more important. I will never agree with that, since I do not consider your safety, or mine, important enough to overturn our constitutional protections. I'm with Ben on this one, and he certainly lived in dangerous times.

What is the risk of an accidental firing of a nuclear missile? Who are these missiles pointing towards? Who should be more scared?
