And they can ONLY be designated by a competant tribunal (a judicial proceeding) so says the Geneva Protocols which we mostly WROTE, and which we signed (& have never withdrawn from)... so they have the force of law. Irregular detainess, captured in war, are PRESUMED to have the status of POW until ruled otherwise....
