The SCOTUS Constitutional opinions from the German Saboteurs may trump the Geneva Protocols but some say International Treaties trump the Constitution which of course is really dangerous. By the way two of the German Saboteurs were naturalized U.S. Citizens. FDR disposed of the American Citizenship problem by saying once these individuals committed to sabotage missions, this was a renunciation of their U.S. Citizenship. Applying this to U.S. Citizens caught in Afghanistan...they are no longer U.S. Citizens, as their acts were a renunciation of their citizenship.
