Well, GOOD... at least you don't believe that any leader's decision to throw someone in jail 'forever' is above the possibility of judicial review!

(So, why do you think the admin. wanted it that way, and claimed they were not required to ever go to court in these cases?)

If you are discussing illegal combatants....no uniform..etc etc, they have little if any protections. Often armies simply dispose of them by firing squad. They are treated like war time spies.

FDR's determination of German Saboteurs was not subject to judicial review. The SCOTUS looked at it and agreed with FDR. Justice Stone wrote the decision. U.S. Citizenship didn't even matter. Two of the saboteurs were naturalized U.S. Citizens. Guess what, FDR said that because of what they planeed to do, they had revoked their U.S. Citizenships.
