The fab is stuck between two process nodes. One would be able to transfer but not worth the ROI and the other too far out.

See my post to Elmer as well. I think it is very much worth it, and the ROI will be there. AMD has signed agreement with Chartered to produce K8 in Chartered fab, which is using IBM 90nm 300mm technology. In addition, it will be used for qualification of tools (that you mentioned) and very likely initial production in Fab36 that will continue until 65nm surpasses it (whenever that happens).

Maybe it would be better to ask why you think AMD would do anything else. You mentioned number of differences in the processes, but, apparently, collaboration between AMD and IBM has resulted in narrowing of these differences at 90nm. IBM does use SOI, and the recent strained silicon announcement on 90nm was a joint announcement.
