<<if distributor offered a special price i do not have a problem. if the distributor on the other hand doesn't even qualify for 1.5 million in credit then it is not a sale imo. it is channel stuffing. they only moved the inventory from tasr to the distributor and booked the sale.. let's see the cash payment.>>

As I said, if it turns out to be BLATANT channel stuffing, then TASR is wrong.....but this happens everyday in biz, and sometimes it is indeed illegal channel stuffing and other times it is just biz as usual.....Is thew distributor guilty if TASR offered them a great deal to buy now, rather then wait til next quarter, and they took advantage of the offer? No. Is TASR guilty for offering special deals to this distributor or any distributor as long as it is done in a legal manner? No. Most companies look to do 'end of quarter/year playing with the numbers'. 80% of businesses I can think of may offer end of quarter/year incentives to retail buyers and distributors. There is nothing illegal about TASR offering a discount to get anybody to BUY NOW. As far as payment on the order goes....who are we to tell tasr how to bill their customers.....anybody tries to tell me how to bill my customers and I will tell them to worry about their own biz....we know nothing about their contracts or payment options for customers/distributors and as a legal biz, I do believe tasr has the right to charge cash, net 30, net 90...hell, they can give their product away...In any event, lets make believe they actually uncover an e-nail or something that actually comes from TASR to Davidson and it says, " we may not meet our numbers this quarter, so tell you what...that order you were going to place next quarter, we'll give you 25% off and favorbale payment options if you place that order now".....Whats wrong with that....They are allowed to offer incentives to buy, whether they are trying to unload overstocked inventory, increase sales or whatever.....the only way I see this is being illegal is if the deal was a bogus deal..they booked it, but then it never actually goes thru for whatever reason...but as long as davidson takes the order, I dont see what is ILLEGAL...maybe not morally correct, but then again...how many businesses offer BIG incentives at end of quarter/year? More then I can count....are they guilty of stuffing the channel or just doing what is best for their biz. I do it all the time....I will always offer customers end of year incentives to unload inventory...inventory they dont need at the time, but will take, due to the incentives and knowing they will need the inventory soon......

So, lets see if this was a legit order or not....I can't help but think....why would Davidson put themselves in harms way by induldging in something blatantly illegal??? My guess is TASR offered them a great deal to get it in this quarter and davidson jumped on it and told tasr they hope it helps them...I see nothing wrong with that, if that is indeed what happened...TASR is allowed to offer incentives, davidson is allowed to accept them and wish TASR luck and say hope this order helps...I get notes like that all the time on large sales....now, if we read the order was cancelled or rescinded by either party...that could be a problem....
