Aside from the fact that the overcrowding is still a myth, the better question is by what right the carpoolers claim exclusive province of the HOV lanes? The reason behind the lanes creation are clear - reducing emissions. There's no mandate to make commuting easier for groups of 2 or 3, the only mandate is that the big cities reduce pollution levels. The commuting convenience is a nice byproduct.

It's for that reason a lot of cities with HOV lanes allow motorcycles to use the lanes. They don't consume much gas and don't issue nearly as much CO and other emissions as automobiles.

The HOV lanes in that part of the world were not created to reduce emissions but to get traffic moving. Letting a handful of hybrids share them for other reasons of late does not change the basic purpose.

In my experience the HOV lanes are underutilized, at least 66 inside the Beltway going towards DC in the morning and away from it in the evening during Rush hour was underutilized last time I commuted that way and many of the cars only had one person in them. If they are very underutilized than the HOV lanes might actually increase emissions as not having them available to most people clogs up other lanes or other routes.
