breen seems to be trying to re-define "inside information" by claiming essentially any information that IS publicly available, BUT NOT disseminated according to breen's definition - is trading on inside information….

to take breen's argument one step further, it appears breen is attempting to re-define stock manipulation as any person who takes a securities position and then disseminates the public information they discovered thru proper due diligence.

very disturbing if true.

if found guilty, essentially everyone long or short publishing good research could be considered committing stock manipulation.

I agree that's an excellent letter by AP counsel. Thanks for posting! So we've seen the government's proposed charge sheet and defense objections and amendments. Does anyone have the actual charge sheet as read to the jury by Judge Dearie? Would be very interesting to see how he ruled.
