This is similar to the argument many people make for the death penalty (which is logically valid, BTW). No one who is guilty of murder and is punished by the death penalty every becomes a recidivist. While factually and logically true, it is also true, that having the same type of bureaucracy that runs the DMV or the IRS in charge of doling out death, produces more travesties that it provides clear improvements to the safety of the population. The factors, mentality and calculations of most people who are on death row are unlikely to have been significantly altered by the cost-benefit rational associated with capital punishment vs. life imprisonment, but the opportunity for an unrecoverable mistake rises from near zero to probable.
