I suspect the jury was more concerned with information flow the other direction - FBI tells Elgindy a company is under investigation or has a scummy past, Elgindy trades on that then issues a report to get the herd to drive it down more. Extorting shares to cover was just icing on the cake, or more precisely, insult added to injury.

In that case he is using illicitly obtained info for his own benefit and manipulating the market at the same time. If he hadn't used FBI database info, I doubt anyone would have cared.

We won't know for sure until the whole verdict and trial transcript are available.
