Back in the ninties, an interesting case was heard in, I think, the New York State Supreme Court. (Could be wrong about the court, but it was definitely in New York. I'm too lazy to go hunt for it.) It was alleged that a number of shortsellers had conspired to short a number of stocks. Phone records and the like were produced.

They were acquitted. The judge (there was no jury) ruled that since they were in the same line of work, it was unsurprising that they talked about stocks and picks among themselves.

I would hope that Tony's attorneys used that ruling to help make their case.
