One of Tony's great talents was swaying people through personal persuasion and charisma. Maybe that's why they opted for a jury - the Batman defense only works if the good people of Gotham believe in Batman.

But by the time he would have testified, Tony had been painted as a chronic liar by everyone who ever dealt with him. And Breen would have picked him apart for weeks on the stand on a zillion SI and site posts, no doubt.

I agree that a judge would not have bought the Batman defense either - but I think it was a lousy product to peddle in any forum.
