"Fairness" is not a concept which is protected by law, for the most part. It may be unfair, it may not be nice, but it's probably not illegal.

It's similar to employers not hiring smokers. Doing testing on existing employees and firing those that smoke may not be illegal, but it sure reeks. I wouldn't work for that company, smoker or not.

It may not be smart, either. It may be cost effective for the drone classes of employees, but a company would have to be pretty dumb to fire a rainmaker or a superstar because he smoked off the job.

I find firing employees for personal habits that don't affect performance pretty darn distasteful.
