This strikes me as a crucial issue for the jury - they must not have believed Elgindy at all when his lawyers claimed he didn't know it was wrong for Royer to give him the classified info.

d. that ELGINDY knew that ROYER had breached his duty by disclosing the information;

Of course, since Royer basically said he had the right to violate FBI rules on giving out information, the jury could have inferred that Royer's defiance was shared with Elgindy, who must have known the information actually came from a "trust and confidence".

Or they simply agreed with everyone else that Tony was a chronic liar.

One layman's guess.
