It was. He lied to SEC, lying to federal agency officials a serious crime as I alleged in the complaint. I spoke a number of times with three SEC attorneys, in due course became exasperated with inaction (but they've been busy). They told me that the problem is when SEC wants to subpoena records, enforcement staff must go to a special tribunal to gain that authority and of course give solid reasons. If it's hidden round one, then, I was told, round two is blocked, SEC cannot subpoena the same materials twice. In civil litigation there are more avenues to obtain discovery - provided your case proceeds past law and motion, attempts to dismiss. Since investigation was probably dropped against Rea the entire file on him should be available.
