The argument goes 'since they are being held under AMERICAN CONTROL, and on what is --- to all effects and purposes say's the Supreme Court --- AMERICAN SOIL (GITMO).'

Green's 75-page opinion was the unclassified version made available for public release. It stemmed from 11 cases involving Guantanamo prisoners.

Her ruling probably will not be the final word on the issue. A different federal judge in Washington, D.C., on Jan. 19 dismissed the cases of seven Guantanamo prisoners on the grounds that they have no recognizable constitutional rights and are subject to the military review process.

The cases could be appealed to the U.S. appeals court, and then ultimately to the U.S. Supreme Court.

Funny how BUSH just adopted the centerpiece of Carter's foreign policy as his own: the promotion of human rights (democracy and the rule of law being foremost among them) around the world!

What used to be called a 'naive Wilsonian/Carter idea'... is now at the center of Bush and neocon doctrine!

What kind of a moronic judge would try to rule on a case where he clearly =has no jurisdiction? Only one appointed by a President who thought the most important business at hand was to pardon draft dodgers (and John Kerry).

Hopefully the SCOTUS will put him back in his place.

OK classify them all as POWs, then they can't challeng their detentions in court, then try them for War Crimes.
