Actually that is exactly what the Bush administration is arguing. Remember they are the ones to call someone an enemy combatant. They could even call you one.

That is EXACTLY what the administration is maintaining in Federal Court! (Of course, they don't word it so baldly, but their language means exactly the same: the right to lock up ANYONE, Americans most definitely included, merely on the Prez's say-so.)
