Scot, check out Cato.org, or learn to use Google or something... or else read ANY major media organization's coverage of the administration's arguments before the federal bench. (ACLU has some good resources on this since they are one of the main groups appearing in court and presenting arguments against the administration's case....) You can even download PDFs of the admin's EXACT LEGAL PLEEDINGS where they state this. Here is how it works: 1) They reserve the right to designate anyone they want to as an 'enemy combatant'. (They gave as an example a 'little old lady in Switzerland...') 2) This designation cannot be appealed or challenged, and they need not provide their evidence. 3) Internment may last indefinitely. We are supposed to take them on their word that they will always get it right... (&, I guess we are supposed to believe that EVERY FUTURE PRESIDENT, even Hilary for example, will ALSO ALWAYS get it right and will NEVER abuse this power.) Personally, just like our Founding Fathers, I believe that power corrupts and absolute power corrupts absolutely... and I DON'T TRUST TO THE INATE 'GOODNESS' OF MAN, rather I believe in checks and balances to keep the tyrants from amassing too much power and erasing the people's liberties and rights.
