"Where your "argument" falls apart is where you claim that "anybody they want" can be an enemy combatant." The admin claims that ONLY the President (or, ANY future President) can make such a designation... and that it is not subject to APPEAL, no evidence need be presented before a court, and indeed, the arrest itself may be SECRET and no acknowledgement ever made of it, no trial ever happen, and internment may be 'indefinite'. That sure sounds like anyone could potentially be so designated (even by accident, if not malice) since there is no check or balance, no way to judicially review evidence... or LACK of evidence. And it's a broader claim to ABSOLUTE POWER then even King George ever made... and he sparked the American Colonies to revolt. Sure sounds like Hell on Earth to me. There isn't a SINGLE signer of our Constitution who wouldn't have called for a rebellion against such an outrageous claim of Kingly power.
