See...this the crux of the problem.........the FF set things up this way in order to make for a well balanced, working democracy.

I'm not arguing against the basic design. I'm arguing for some limits of power here. If the judiciary has all of the powers of the legislature to write new laws, that's going way too far. On the other hand, the judiciary can't avoid having a hand in writing new laws, so the argument is over shades of gray.


The courts do not have all the powers of the legislature. If in the course of their interpreting the law, they determine that some element of the law is constitutional or unconstitutional, then the legislature has to create law to satisfy the court's interpretation. For an example, with Roe vs Wade, the courts interpreted the constitution to mean that abortions are permitted. That didn't mean you could go out and have an abortion. The states first had to pass laws permitting abortion before anything could change.

The war Rossi is waging in WA state is being run by Rove and company back in DC. He sent his attorneys out weeks ago. They refuse to back down. They are looking for a new tactic to fight this battle.

I don't get the analogy at all.

At the present time, Rove is the brains behind the GOP. Its no secret he likes to win. When it became apparent the election was close in WA state, he sent his people out. Up until then, relations between the two parties had been competitive but were friendly. No longer........so much bad blood has been created in the past three months, they are ready to spit when they see each other. Its been a lesson to watch.
