I think you're trying to argue that laws are written by legislatures? Which is a great argument if you live in a country that adheres to civil law principles rather than common law principles.

In the US, a common law country for the most part, judges do make law, and the rest of us are bound to follow that. It's called stare decisis.

I have heard that Justice Thomas doesn't believe in stare decisis, but I have a hard time believing that he doesn't believe in stare decisis when it suits him.
