I think "most people" don't realize that if they were in the shoes of the judge, they'd do exactly what the judges do, only the results might be different

I don't see any other way of doing it. Even Civil Law judges do it to a lesser extent, though they have to pretend that its all there in the statute. It's not possible to eliminate discretion from the equation - law isn't physics.
