The law recognizes the power disparity between children and adults and presumes that when the child is of a certain age, say, between 12 and 14, and the other party is more than three years older, that the child is legally incapable of consenting to have sex. More than anything, its a policy decision.

Precisely. And like all policy decisions, or at least all good policy decisions, it acts fairly on most and unfairly on some. (Bad policy decisions act unfairly on more than some.)

It's another example of a Big Brother government protecting some who would be just as happy not to be protected, thank you very much. But if the most want or need protection, all get it.

(Same principle as the argument for gun control, isn't it? Since some people are incapable of using guns wisely and safely and society needs to be protected from their owning them, nobody should be allowed to own guns, even those who could use them responsibly and safely. Different clothes, same argument.)
