The government has no such duty. We don't live in a Nanny state.

Of course the US government's duties include promoting healthy activities among its population. How else do you explain cigarette bans, the FDA, national exercise programs in public schools, mandatory labeling of fats and calories on various foods and the Department of Health (if they still exist)?
