I believe this is the devil lurking in the details. As I understand, the problem with a law that recognizes the difference between marriage for heterosexuals and civil unions for homosexuals is that the law doesn't distinguish between the two. You can get married in a church or hitched at city hall, and the law sees it the same.

What Kerry and his advisors never understood was how to set up the game so that it's won before it's contested. In Go, it's called having sente; basically, retaining the attack, deciding the battlefield, and keeping your opponent on the defensive.
